"For almost a century the courts have sanctioned a number of constitutional violations that helped fuel the ?rise and rise? of the administrative state, including violations of the courts? duty under Article III. Though the criticism has been sustained throughout that period, there is new reason to think the current political, intellectual, and judicial climate is ripe for meaningful moves back to the constitutional order. Whether that prediction is correct or not, there ought to be no dispute among honest and thoughtful scholars regarding the following violations of the structural Constitution."
